DSS Takes El-Rufai Into Custody After Court Hearing in Kaduna

Operatives of Nigeria’s domestic intelligence agency, the Department of State Services (DSS), on Wednesday took former Kaduna State governor, Nasir El-Rufai, into custody shortly after proceedings concluded at the Federal High Court in Kaduna.

The dramatic development followed a hearing on El-Rufai’s bail application in an ongoing corruption case that has drawn national attention. According to eyewitness accounts and court observers, the former governor had just finished presenting arguments through his legal team when DSS operatives moved in swiftly, escorting him out of the court premises under tight security.

Sources familiar with the situation disclosed that El-Rufai was immediately driven away in a convoy of security vehicles and subsequently transported to Abuja. The reason for the swift transfer was not officially disclosed at the time of filing this report, but it is believed to be connected to a separate investigation being handled by the security agency.

Security presence around the court premises had been noticeably heightened even before proceedings began, fueling speculation among journalists, lawyers, and members of the public that a significant development was imminent. Several DSS vehicles were strategically stationed both within and outside the court complex, while armed operatives maintained strict surveillance of movements in the area.

El-Rufai arrived at the court earlier in the morning at approximately 9:05 a.m. in a Hilux van, accompanied by members of his legal team and aides. His appearance attracted considerable attention from onlookers, including supporters, political observers, and security personnel who had gathered to witness the proceedings.

Inside the courtroom, proceedings continued without interruption, as both the prosecution and defence presented their submissions regarding the bail application. The prosecution reportedly opposed the request, arguing that the charges against the former governor were serious and that granting bail could interfere with ongoing investigations. The defence, on the other hand, urged the court to grant bail on the grounds that El-Rufai had cooperated with authorities and posed no flight risk.

Speaking to journalists shortly after the session, lead defence counsel, Oluwole Iyamu (SAN), confirmed that the court had reserved its ruling on the bail application until April 14. He expressed confidence in the judicial process and maintained that the defence had presented a strong case.

“The bail application was argued and responded to, and the ruling has been fixed for April 14. We look forward to that day. We are hopeful. We have put our arguments before the court, and this is a court of justice. We await the decision of the court,” Iyamu stated.

He further disclosed that his client is also involved in a separate legal matter scheduled to be heard on April 10 at the Federal High Court in Abuja. According to him, that case is specifically related to an investigation by the DSS and is distinct from the current corruption trial.

“That is a separate matter. As lawyers, we are ready. We have filed all necessary processes and will be in court. That is the DSS matter,” he added.

The arrest came amid ongoing legal battles involving El-Rufai, who has been facing multiple allegations tied to his tenure as governor of Kaduna State. The latest court proceedings followed a brief disruption a day earlier, when legal arguments were raised over a motion requesting the presiding judge, Rilwan M. Aikawa, to recuse himself from the case.

The motion, which had the potential to delay proceedings significantly, was eventually withdrawn after deliberations, allowing the court to proceed with hearing the bail application without further hindrance. Legal analysts noted that the withdrawal of the motion cleared the path for the case to move forward more swiftly.

Prior to the current trial at the Federal High Court, El-Rufai had also been arraigned before the Kaduna State High Court in Kawo alongside a co-defendant, Amadu Sule. In that case, both men are facing charges bordering on abuse of office, fraud, and the alleged granting of undue advantage during their time in public office.

Legal experts have emphasized that the charges in the Kaduna State High Court are separate from those being handled at the Federal High Court, indicating that the former governor may be dealing with multiple legal challenges simultaneously.

The unfolding developments have sparked widespread reactions across political and legal circles in Nigeria, with many observers closely monitoring the implications of the DSS action. While some analysts view the arrest as part of a broader effort to enforce accountability among public officials, others have raised concerns about the timing and manner of the operation, particularly given that it occurred immediately after a court session.

As of the time of this report, officials of the DSS had not issued an official statement detailing the reasons for El-Rufai’s arrest or the nature of the investigation that led to his transfer to Abuja. Efforts to obtain comments from the agency were unsuccessful.

Meanwhile, attention is now focused on the upcoming court dates, including the April 10 hearing in Abuja and the April 14 ruling on the bail application. These proceedings are expected to play a crucial role in determining the immediate legal future of the former governor.

The case continues to generate intense public interest, reflecting broader concerns about governance, accountability, and the rule of law in Nigeria. As events unfold, stakeholders across the country are expected to keep a close watch on the judicial process and the actions of security agencies involved in the matter.
