Court Clarifies Oversight Boundaries Between FCCPC and NCC in Nigeria's Airtime Lending Market

 


The Federal High Court in Lagos ruled that the Federal Competition and Consumer Protection Commission possesses valid statutory authority to oversee airtime and data credit services, while affirming that the commission lacks the legal power to issue telecommunications licenses. Delivering judgment in Suit No. FHC/L/CS/760/2026, Justice Ambrose Lewis-Allagoa determined that the regulatory mandate of the commission operates concurrently with that of the Nigerian Communications Commission rather than superseding or replacing it.

The judgment dismissed a legal challenge brought by the Wireless Application Service Providers Association of Nigeria, holding that the commission acted within its statutory and constitutional powers in enacting the Digital, Electronic, Online, or Non-Traditional Consumer Lending Regulations 2025. Addressing the interaction between the multi-sector consumer body and industry-specific authorities, the court noted that concurrency implies coexistence rather than displacement.

Under the framework established by Sections 104 and 105 of the Federal Competition and Consumer Protection Act 2018, the court confirmed the primary role of the commission in consumer protection and market competition matters. At the same time, the ruling preserved the exclusive jurisdiction of the Nigerian Communications Commission over technical standards, licensing frameworks, and prudential oversight under the Nigerian Communications Act 2003. The court explicitly clarified that the consumer lending regulations do not establish a telecommunications licensing framework, confirming that licensing authority remains solely with the communications regulator.

The judicial clarification introduces new questions regarding recent administrative actions taken under the framework. In April 2026, the consumer commission approved five corporate entities to operate as airtime and data credit providers, raising scrutiny regarding the precise regulatory basis of those approvals following the court's finding on licensing restrictions.

The decision marks the first formal judicial interpretation governing shared oversight in the nation's airtime and data lending market. The sector generates between three hundred billion and four hundred billion naira annually and serves an estimated forty million Nigerian consumers daily.

Responding to the verdict, Gbenga Adebayo, Chairman of the Association of Licensed Telecommunications Operators of Nigeria, welcomed the legal clarity provided by the court. Adebayo highlighted that while the ruling confirms the authority of the consumer commission, it also protects the statutory mandate of the communications regulator. He urged both regulatory bodies to establish a formal coordination framework and conduct consultations with industry stakeholders before taking enforcement measures that could cause service interruptions.

Adebayo pointed out that airtime credit services had previously experienced a three-month suspension following earlier regulatory enforcement directives before being restored. He emphasized the importance of maintaining service continuity for the millions of citizens who rely on short-term airtime credit. Furthermore, industry representatives highlighted that a directive issued by the Presidential Enabling Business Environment Council on April 6, 2026, which mandates all federal agencies to complete a comprehensive Regulatory Impact Assessment prior to implementing major regulatory updates, remains active and binding on both institutions.

The court's ruling sets a significant legal precedent for managing overlapping mandates between specialized sector regulators and general consumer protection authorities as digital financial products continue to evolve across traditional regulatory boundaries in Nigeria.
